1. Acceptance of terms

These Terms of Use (“Terms”) are a legal agreement between you and zoubobAI LLC (“zoubobAI”, “we”, “us”) governing your access to and use of our website at zoubobai.com and any mobile applications and web tools we publish (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License to use our apps

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use our applications for your personal, non-commercial use, solely as permitted by the App Store terms of service and these Terms.

Applications distributed through the Apple App Store are licensed to you, not sold. Apple’s Standard End User License Agreement (EULA) applies to those apps except where these Terms are more restrictive, in which case these Terms control.

We reserve all rights not expressly granted to you in these Terms.

3. Acceptable use

You agree not to:

• use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• copy, modify, distribute, sell, lease, or sublicense any part of the Services, except as expressly permitted by applicable law;
• reverse engineer, decompile, or attempt to extract the source code of our apps, except to the extent permitted by applicable law;
• interfere with or disrupt the operation of the Services, or attempt to gain unauthorized access to any systems or networks connected to the Services;
• scrape, harvest, or collect information from this website using automated means without our prior written permission; or
• remove, obscure, or alter any copyright, trademark, or other proprietary notices in the Services.

4. Subscriptions and payments

Purchases and subscriptions for our iOS apps are offered through the Apple App Store and processed by Apple. When you subscribe, payment will be charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscriptions in your App Store account settings. Prices, taxes, and billing currency are determined by Apple.

We do not collect or store your payment card details for App Store purchases.

5. Refunds

Because App Store purchases are processed by Apple, refunds are handled under Apple’s refund policy. You may request a refund from Apple at reportaproblem.apple.com or through Apple Support. If you have difficulty with a refund request, contact us at help@zoubobai.com and we will assist where we reasonably can.

6. Intellectual property

The Services, including all software, text, graphics, logos, and design, are owned by zoubobAI LLC or its licensors and are protected by United States and international intellectual property laws. “zoubobAI” and the zoubobAI name and marks are trademarks of zoubobAI LLC. Nothing in these Terms transfers ownership of any intellectual property rights to you.

7. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Services will meet your requirements. You use the Services at your own discretion and risk.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event will zoubobAI LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months preceding the claim, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow certain limitations of warranties or liability, so some of the above may not apply to you.

9. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict-of-law principles. Subject to applicable law, the state or federal courts located in the State of Wyoming will have exclusive jurisdiction over any dispute arising from these Terms or the Services, and you consent to their jurisdiction and venue.

10. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes may also be announced within our apps or on this website. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

11. Apple-specific terms

You and zoubobAI LLC acknowledge that these Terms are between you and us only, and not with Apple Inc. (“Apple”). Apple is not responsible for our apps or their content. To the maximum extent permitted by applicable law, Apple will have no warranty obligation with respect to our apps. Apple is a third-party beneficiary of these Terms and, upon your acceptance, has the right to enforce these Terms against you as a third-party beneficiary. Your use of our iOS apps must also comply with the App Store terms of service.
